Any images you submit become copyrights of Spencer Gifts. By submitting an image, you express that you own all rights to the image and grant Spencer's Gifts the rights to publish the image as they see fit.

PHOTO LICENSE, RELEASE AND WAIVER

To submit your photo ("Photo"), please read the following License, Release and Waiver and click on the checkbox below and submit the waiver.

1. You grant to Spencer Gifts LLC and its affiliated, related and associated entities, contractors and partners (whether affiliated or not) and each of their assigns and successors (together "Spencer Gifts"), the non-exclusive and royalty-free right and license, (but not the obligation), in perpetuity, throughout the world, in any and all media now known or hereafter devised, to communicate to the public by way of unlimited public display Photo or any part thereof, on www.spencersonline.com.

2. You represent and warrant that the Photo you submit is an original work by you, that you own or control 100% of the rights in and to your Photo and the rights granted to Spencer Gifts in this license, and such rights are and shall be free and clear of any and all claims, rights and obligations; and that you have the right to grant to Spencer Gifts the rights granted to us in this license, you do not require the consent of any third party and that there is no contract with any third party that could in any way interfere with Spencer Gifts’ rights under this license or require any payment to be made to anyone by Spencer Gifts. You further represent and warrant that each individual depicted in your Photo is eighteen (18) years of age or older and has been advised and consented to the display of the Photo on www.spencersonline.com.

3. You agree to indemnify and hold Spencer Gifts harmless from and against all claims, demands, loss, liability, damages and expenses (including legal fees and disbursements), including actions for infringement of copyright, any third party claim inconsistent with your representations and warranties or otherwise in connection with our use of your Photo under the terms of this license.

4. If this agreement is terminated (by written notice), then you understand that Spencer Gifts will continue to be able to use the Photo previously submitted by you, as indicated above.
